Once again, I come to you with a serious matter.
As a photographer, I often deal with copyrights. When I take a photo of someone, I always get verbal consent from them, and if needed, written. I also always (unless otherwise stated) Copyright my photos, to try and prevent people from stealing my photos and using them without my permission. However, sometimes it isn't enough. In a recent situation, a close friend of mine had taken one of my photos and removed my copyright from it, and began claiming it as his own, as if HE took it. When I brought it to his attention, he began to curse me out and started claiming it was his. I just want people to know, I do not tolerate people stealing from me and claiming it as their work, it is rude, and illegal, so please do not do such acts. No usually I would just continue to ask him to replace it with the original, which is available on my flickr. In fact, I don't mind if people show off their photo I took if they keep the copyright on it, but when they remove it claiming it as their own, they cross the line. So I would like people to know, DON'T claim my work as yours. It is rude, it is stupid, and ILLEGAL. So all I can say to this person (which i have no idea why Im keeping it secret), I hope you like the inside of a court room, because you will be seeing it for a long while if you don't drop this now.

You gotta have a better approach to these things... You sound like a whiner and you have a huge "oh pity me" attitude. You did not deal with this well and it is your own fault that it blew up in your face.

ReplyDeletePlease note that he used a low res picture that was posted onto Facebook. If you read the terms and conditions, all images you upload onto Facebook belongs to them and by uploading, you are releasing any ownership of the photo.
ReplyDeleteHence, that photo, the low res one, does not belong to you anymore and he has full rights to use it.
Suing someone over a 600 pixel pic is ridiculous; please Ryan, grow up and stop the empty threats.
actually they were posted from flickr, if you notice, I dont have the photo on facebook. And it isnt your place to tell me what to do and not do. and they arent empty threats, I am getting a lawyer for this.

ReplyDeleteBut you uploaded it to facebook, if you sue someone for copyright of the picture, facebook has the right to sue you.
Also try having a verbal agreement hold up in court without a witness.
I did not have it on facebook actually, it was taken from my flickr account, not the same laws there. And I do have a witness, about 5 or 6 of them, who where there as I took the photo. Either way, tho, facebook has removed all the photos that I owned that he took.
